    Standing

    One must have a compelling interest in the outcome of a suit to bring the suit.  Put another way, a sufficient stake in a challenge or action to make it a case or otherwise a controversy.

    It matters only if it matters to you.

    At least that is the way some cases have been ended.  If you have no compelling interest, why might you bring a suit?  What does the ACLU do when it wants to prove a point? It shops out for a plaintiff, the "victim" of some particular law or abrogation of what the ACLU might perceive to be rights, either real or imagined.

    Indeed, some things matter to all of us, but we must suffer the wait for a "directly" affected party.  ~ continue below ~

    Republican's First 100 Days

    When Republicans take back control of both houses of Congress in January, their first order of business must be voting to restore all of the Bush tax cuts. Yes, even the cuts for those evil capitalist pigs considered The Rich. If President Obama vetoes it, he will only be sealing his political fate to a one-term presidency. Even the most hateful class warrior subconsciously understands that raising anyone's taxes in the midst of an economic depression only worsens an already dire situation.

    The next step is to sell off any remaining government ownership and control of GM and Chrysler. The automakers need to sink or swim on their own in the free market.

    Then it's time to cancel any further spending from the balance remaining in the Obama-stash stimulus bill. Reportedly, only half of the $1 Trillion Obama slush fund has been spent. Do NOT spend the remaining half billion dollar balance. That will automatically cut 2011's projected $1 Trillion-plus deficit in half.

    Can Alton Davis Even Be Nominated for the 2010 Election?

    Really..  Can he?

    Unless.. he had ALREADY filed the affidavit prior to his commission by governor Granholm?  From the Michigan Constitution:

    § 2 Justices of the supreme court; number, term, nomination, election.

    Sec. 2. The supreme court shall consist of seven justices elected at non-partisan elections as provided by law. The term of office shall be eight years and not more than two terms of office shall expire at the same time. Nominations for justices of the supreme court shall be in the manner prescribed by law. Any incumbent justice whose term is to expire may become a candidate for re-election by filing an affidavit of candidacy, in the form and manner prescribed by law, not less than 180 days prior to the expiration of his term.

    It is 121 Days till the end of his term... His appointment to fill the remaining term was 6 days ago..

    Am I reading this wrong?

    The fake Tea Party has filed an application for leave to appeal with the Michigan Supreme Court, asking that court to overturn the Michigan Court of Appeals, a panel of which voted unanimously that the FTP should not be on the November ballot. With the much publicized departure of E. Weaver and the elevation of Alton Davis, this will be the first rule-of-law test for the newly constituted Supreme Court.

    A Most Pernicious Pest

    They're Back.

    The Fake Tea creation of the Michigan Democrats are hoping to take advantage of retired justice Weaver's slight to the Republicans, and perhaps citizens of Michigan.  The lawyer for "The Tea Party" Michael Hodge, has filed to the Michigan supreme Court, requesting it reviews the Appeals court decision.

    There is now a 4-3 construction of the Michigan Supreme court that favors Democrat "interpretation activism" versus the 3-1-3 balance between Proper refereeing-"Who Knows anymore"-Interpretation activism.  MLive reports:

    "The Tea Party" filed an emergency appeal Tuesday, according to a Supreme Court spokeswoman. Attorney John Pirich, who represents the GOP and tea partiers, said he'll decide what steps to take once he reviews the appeal.

    A lawyer for "The Tea Party," Michael Hodge, has argued that the size of the type face isn't reason enough to keep "The Tea Party" off the ballot since the group's petitions substantially meet state requirements. State election officials estimate the party submitted about 45,000 valid voter signatures, far more than required by state law.


    Heck..  I guess it doesn't matter that there were candidates who were not eligible, filed improperly, didn't know they were running, etc..

    We'll see if the Supreme court has been seriously compromised by this change.  We'll see if the 4 Justice majority of activists serve their masters well.  And we will see how hard we will have to work to defeat the newly designated incumbent leftist justice Alton Davis, come November.

    Ambulance Chasers of the Intellectual Property realm

    The WSJ today has a piece on how the ambulance chasers of the IP realm are going after companies who have expired patent numbers on goods.

    From the article:


    Lawyers for product manufacturers now fear clients are liable for up to $500 for every tube of mascara or box of garbage bags marked with an expired patent--an error that turns out to be quite common.

    In recent months, would-be plaintiffs have been fanning out across retail stores and the Internet searching for expired patent numbers on everything from toothpaste to toilet plungers.

    Now that's classy. Of course the reasoning?


    The people behind the suits say they see themselves as consumer advocates, helping to protect legitimate inventors from giant corporations who are pretending to have patents to keep competitors from stepping on their turf.

    "It chills competition, it misleads the public and takes away from the credit patent holders deserve," says Daniel Ravicher, founder and executive director of New York nonprofit Public Patent Foundation, which has filed numerous suits.

    Consumer advocates? Chills competition?

    Let me give some insight: Joe Public isn't going to care about a patent. It means essentially nothing to them. The only people that would care about it are entities looking to produce an identical or similar product. At that point in time, all the said entity has to do is do a quick search to see if the patent is expired or not. You can even type a patent number into google and it will pull it up.

    This has absolutely nothing to do with "consumer advocacy" or false advertising, but rather, it has everything to do with attorneys who probably don't have clients because they're shitty at their profession so they need to make money in unscrupulous ways.

    Democrat Pick For AG Too Busy

    For his Job?

    Remember that guy from Michigan who went around stabbing people?  That guy, Elias Abuelazam, has been arraigned on a charge of assault with intent to murder. And while he has only been charged for one attack, more charges can be expected. Abuelazam, to date, is accused of stabbing 13 people in Flint, 5 of those resulting in death. There is also 1 Ohio non-fatal stabbing, an additional 3 non-fatal attacks in Virginia, and an investigation into a probable link to a 2009 homicide stabbing in that same state.

    Last Thursday, Abuelazam was extradited from Atlanta to Michigan. The extradition process alone was drawn out and costly.

    The Virginia connection has problems however.  It seems while the Flint attacks were linked to the Virginia attacks, a full two weeks before the extradition process, there was no attempt to contact the Virginia officials by the Genesee prosecutor.  In fact, the prosecutor for Loundoun County in the Commonwealth of Virginia, Jim Plowman publicly criticized David Leyton for not returning his calls or messages. On one occasion, Plowman claims he asked to speak directly to David Leyton regarding the Abuelazam case.
     

    "You'd think they'd return my phone calls, especially since I have information that will help them,"

    Plowman described leaving a detailed message for an assistant prosecutor, asking to talk directly with Genesee County prosecutor David Leyton. It seems he is still waiting:
    "I know multi-jurisdictional cases are tough, but I should be able to get my counterpart on the phone."
