    Self Defense and Tasers

    In the 2005-06 legislative term, I worked on a comprehensive package of bills safeguarding citizen's right to self-defense that became known as the "Castle Doctrine."  It was named after Dr. Ossian Sweet who defended his life and the lives of his family in their Detroit home in 1925 when he shot and killed an attacker.  Charged with murder he was tried and exonerated.  Thus came the saying, "a man's home is his castle" which led to the "castle doctrine."

    While I was with the Eaton County Sheriff's Office, I had a breaking-and-entering case of when a complete stranger broke into a couple's Dimondale home.  He violently attacked the couple; while fighting for his life the man yelled to his wife to get help.  She immediately ran to his aid with a large jar of pennies and broke the large jar over the bad guy's head.  The innocent homeowners survived the attack while the criminal was taken to the hospital.  The crook later brought a civil lawsuit against the victims for using "excessive force".  

    When I was elected to the House, I wanted to ensure that this could not happen again.  It is simply not right for a victim to become victimized again when they were merely defending themselves or another person. It was my objective to craft law so that if you were about to be murdered, suffer great bodily harm, or be raped that you would have the right to defend yourself and not be prosecuted.  The self-defense law--also known as the Castle Doctrine--was passed after a long fight with liberals who opposed it.

    My latest battle with liberals who want to diminish our abilities to defend ourselves is allowing the use of a device called a taser for civilians.  This is a non-lethal device that uses electricity to incapacitate a person.  The device allows people to defend themselves without taking a life.  Currently in Michigan, you may receive special training and obtain a concealed weapons permit (CPL) to carry a handgun if you have no felony record.  A package of bills authored by Geoff Hansen, Arlan Meekhoff and myself, will allow Michigan CPL holders, the option of carrying a Taser. Forty-three other states already allow citizens the option of carrying a taser instead of a firearm; Michigan should be next.

    The citizen Taser is a one shot device designed for defense.  I think it is common sense that  citizens of Michigan should be given every possible option of defending themselves from attack.

    Rep. Jones, I'm glad to see that HB 5108 passed with quite the considerable margin (101-7). My concern is with Paragraph 6(A).

    THE INDIVIDUAL PROVIDES DOCUMENTATION THAT THE INDIVIDUAL
    3 IS HONORABLY DISCHARGED FROM THE ARMED FORCES OF THIS STATE,
    4 ANOTHER STATE, OR THE UNITED STATES.

    Why aren't people who are currently in the military that have pistol training exempted? Certainly too late for a house amendment at this point (I did email Sen. Allen - no response yet though). However if it does pass (it should?) would it be possible to amend it so that it does include currently serving members?

    ... why is "allowing" a citizen to carry a taser paired with CPL AT ALL?  In one case we have a firearm that is extremely lethal, in the other one that is of limited range, single use, and not lethal at all.  
    I agree, it is criminally stupid that current law bans our ability to pack a taser, while letting people carry a weapon that kills.  But a law that implies somehow tasers are actually MORE dangerous than firearms is little better.  Let's get to work at deregulating tasers altogether, and getting government out of the way of self defense.
