    Macomb (democratic) County Clerk gets slapped down over AV fiasco.

    It worked in Wayne County.

    Well, for a while, anyway. until it got struck down by the courts.

    But will this time-honored tactic work in Macomb County?

    The tactic in question is the sending out of unsolicited AV applications to those who never asked for them in the first place.

    Well, that's just plain stupid! With concern over voter fraud at high levels, why would anyone want to do that?

    A democrat, that's who.

    Several years ago, Detroit City Clerk Jackie Currie pulled that very same stunt. But sending out application to people who don't ask for them invites all kinds of problems, including dead people voting.

    The process was eventually halted by the courts, and everything was thought over and done with.

    Think again.

    Fast-forward to 2006. Looking for a method to pump up (democratic) voters in Macomb County, County Clerk Carmella Sabaugh tried the same tactic. Sending out unsolicited AV applications to only one category of AV voters in an attempt to increase democratic votes on election day.

    Well, not so fast, says the Michigan Court of Appeals. In a decision released last Friday, they ruled that Macomb County Clerk Carmella Sabaugh:

    "violated the purity of elections clause of the Michigan Constitution ... because mailing of absent voter applications to only a select group of eligible absent voters undermines the fairness and evenhandedness of the application of election laws in this state."

    Now by this point, the democrat/progressive/liberal/whatever the name-is-this-week crowd are going to say, "Waitaminit!"

    "Why are you constantly bringing up the fact that this woman is a democrat?"

    "Election Clerks are supposed to be independent and not show any party bias."

    "Why keep calling her a democrat, when she's non-partisian?"

    Well, read on true believers, and you find out why.

    When pressed for a comment about the ruling against her, County Clerk Sabaugh stated:

    "I am disappointed that judges in a presidential election year would rule for the Republican Party in an unpublished opinion to make it harder for senior citizens to get an (absent voter) form," she said in a statement Friday. "I am reviewing my options for appeal."

    No word yet on when SoS Land will investigate these partisian comments or if she'll make a statement on this ruling for other Clerks in Michigan to refer to in the future.

    Sabaugh just doesn't get it.  The legal opinion rendered by the Court of Appeals is that it all voters, not just any one select group, shall be treated EQUALLY under applicable election laws.  In other words, a county clerk shall neither impede nor favor one's access to the election ballot.  

    In this case, Sabaugh was trying to favor one particular group -- the senior citizens.  Furthermore, Sabaugh was using taxpayer money in her effort to distribute absentee ballots to all the senior citizens in Macomb County.  If Sabaugh was truly intellectually honest about faciliting voter access, then she should have distributed absentee ballots to every single registered voter regardless of age, gender, color, ethnic origin, etc.  The fact that Sabaugh did this while she was a candidate for Secretary of State only underscores that she is unfit to serve the people not only as Secretary of State but also County Clerk since she should know better.
